OpenHouseIQ provides a digital lead capture and follow-up platform for real estate professionals. Features may include:

  • QR-based open house sign-in
  • Lead data collection (name, phone number, email, etc.)
  • Automated SMS and/or email follow-ups
  • Listing information delivery
  • Lead tracking and analytics
  • We may update, modify, or discontinue features at any time.

2. Eligibility

You must be at least 18 years old to use the Service.

If you use the Service on behalf of a business or brokerage, you represent that you have authority to bind that entity to these Terms.

3. User Responsibilities

You are solely responsible for your use of the Service.

You agree that you will:

  • Provide accurate and truthful information
  • Comply with all applicable laws and regulations
  • Obtain all necessary permissions and consents from individuals whose data you collect

Real Estate and Open House Use

You are responsible for ensuring that:

  • Visitors voluntarily provide their information
  • Visitors consent to receive communications (including SMS and email)
  • Any required disclosures (including representation status or brokerage disclosures) are properly presented
  • OpenHouseIQ does not provide legal advice or guarantee compliance with any real estate laws or regulations.

4. Communications and SMS Compliance

You agree that:

  • You will only contact individuals who have provided valid consent
  • You are responsible for complying with all applicable communication laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM
  • OpenHouseIQ provides communication tools but does not control how you use them
  • You are responsible for honoring opt-out requests (for example, replying STOP to SMS messages).

5. No Guarantee of Delivery

We do not guarantee:

  • Delivery of SMS or email messages
  • Accuracy of user-submitted data
  • Continuous availability of the Service
  • Delivery failures may occur due to third-party services, including carriers and messaging providers.

6. Data Ownership

You retain ownership of your data, including lead information.

You grant OpenHouseIQ a limited license to store, process, and transmit data solely to provide the Service.

We do not sell your data.

7. Acceptable Use

You agree not to:

  • Send unsolicited or unlawful communications
  • Use the Service for spam or harassment
  • Violate any laws or regulations
  • Attempt to interfere with or disrupt the Service
  • We may suspend or terminate accounts that violate these Terms.

8. Subscription and Billing

  • Payments are non-refundable unless explicitly stated otherwise

9. Termination

We may suspend or terminate your access to the Service at any time if:

  • Lost leads or missed opportunities
  • Communication failures or delays
  • Data inaccuracies
  • Any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid us in the past three (3) months.

12. Indemnification

You agree to indemnify and hold OpenHouseIQ harmless from any claims, damages, or liabilities arising from:

  • Your use of the Service
  • Your communications with leads
  • Your violation of applicable laws or regulations

13. Compliance Disclaimer

OpenHouseIQ provides tools to assist with open house workflows but does not guarantee compliance with:

  • State or federal real estate laws
  • Brokerage requirements
  • Licensing obligations
  • You are solely responsible for compliance in your jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance.
